One dark evening, Sophie was returning home from work on her electric scooter. She was travelling in the bike lane, when suddenly and without warning, her scooter hit an unmarked obstruction causing Sophie to go over her handlebars and land on her left arm.
Sophie saw immediately that the obstruction that caused her accident was a lump of black tar that had been placed in the bike lane after recent road works.
Sophie had her injuries assessed at a local clinic. Her left wrist was fractured, and she had bruising to her left thigh. Sophie had to wear a cast for six weeks and was given physiotherapy advice by her GP to help her recovery.
Sophie was unable to work for 2 weeks after her accident.
Sophie still experiences weakness in her left wrist and she feels pain when lifting heavy objects at work.
The defendants were negligent in their duty to maintain a safe environment for road users. As a direct result of this negligence, Sophie suffered not only physical injuries but also ongoing pain, and reduced mobility.
The Injuries Resolution Board assessed the injury at €5,377. Solicitor Philip Gleeson reviewed the Injuries Resolution Board assessment and felt that it did not properly compensate Sophie for the injuries incurred. Philip instead instigated Court proceedings, and the case was brought to a successful conclusion.
The case was settled on the 21st of May 2025 for the sum of €10,245. This was a great result for our client, we are proud of all the work put in by Philip Gleeson and his team to achieve this outcome.
