Struck by a phantom driver – one who does not stop and flees the scene of an accident!
If you have been injured in a road traffic accident where the driver of the vehicle is uninsured or where the driver of the vehicle flees and you have no insurance details for them then don’t despair – this does not mean that you are prevented from making a personal injury claim.
The MIBI Agreement covers personal injury claims for individuals involved in road traffic accidents irrespective of whether the offending vehicle is identified or not.
The MIBI Agreement may also cover claims for property damage that may have occurred during the car accident but in the case of property damage, the offending vehicle must be identified by a valid registration plate.
If you are involved in such a road traffic accident then you should as soon as possible ensure that you are medically treated for your injuries and also notify the Gardaí of the accident. You should keep a record of the Garda Station that you report the accident to, the date of notification and the Garda’s name to whom you reported the accident.
Please be aware that there are strict time lines involved in notifying the MIBI following a road traffic accident. You should ensure that you contact the MIBI and complete the MIBI claim form within this time limit.
Once notified the MIBI will conduct investigations to include establishing the facts of the accident, checking the insurance position, obtaining a Garda report from the scene of the car accident, obtaining a motor assessor’s report on your vehicle(if applicable) and obtaining copies of your medical records.
