Injury: Trauma to tendons on right hand
Incident: Rafal was cutting a metal bar in work using a metal saw. The metal bar was placed on two support frames to his left. One of the supportive frames had shorter legs on one side and as a result the frames were not balanced adequately. When Rafal was in the process of cutting the bar, the bar slipped off the frame onto the second lower frame. The bar then bounced upwards thus pushing his right hand up against the blade of the saw. Rafal suffered lacerations to three of his tendons affecting his index and his middle finger. As a result he had to have surgery and physiotherapy where it was found the tendons had ruptured again thus resulting in a second surgery. He could not carry out simple activities such as opening the door of his car or hold a bottle of water due to his injuries sustained. He could not extend his index or middle finger due to sustaining an extensor tendon injury in addition to a soft tissue laceration.
Case Progression: Rafal rejected the Personal Injuries Board offer and proceedings were issued on the 01/12/17.
Settlement: The case was settled on the 03/07/2018. Rafal’s workplace failed in their duty of care to him by not providing a work station that was safe and without risk.
