Process & Procedures

As you may never have previously had to take legal action in respect of recovering your debts, we appreciate that you may not be familiar with the process and the procedures that are involved. Just to give you some idea, we have broken it down into the three main stages: -

Stage 1: - Issue of Demand Letter(s)

A demand letter will be issued to the debtor seeking the recovery of your outstanding account. They will be given a deadline of 7 days from the date of the letter to discharge the outstanding account.

An optional follow up letter of demand can be issued if the debtor fails to respond to the initial letter.

The standard letter of demand that we issue is the Tough letter. Our Soft and Very Soft letters are designed for clients who want to incorporate our letters into their credit control process.

(Please note: We are obliged to issue one letter of demand advising the debtor of our intentions to issue proceedings should the account remain unpaid, our tough & soft letter meet with this requirement)

Stage 2: - Issue of Legal Proceedings

If they debtor fails to respond to the demand letter(s) legal proceedings can then be issued and served on the debtor.

Should the debtor fail to respond or acknowledge the proceedings we can then make an application for Judgment against the debtor.

Please note: - The procedure regarding the issue and timeframe for responding to legal proceedings varies, depending on the court e.g. District, Circuit or High Court. However, full details will be outlined to you at the stage of issuing proceedings.

Stage 3: - Enforcement

Once Judgment has been obtained against the debtor you can then seek to enforce the Judgment through various options.
